In this privacy statement we describe how Nearshoring Partners (hereinafter: ‘Nearshoring’) and its affiliates process of personal data of their customers.

Scope. This privacy statement is applicable to all business relations between Nearshoring and its customers/prospects, of whom Nearshoring Partners processes personal data.  The privacy statement  extends to: (1) the customers and prospects who have contacted Nearshoring, or with whom Nearshoring has made contact; (2) the recipients of invitations, such as for business events or seminars; (3) the recipients of commercial communications, such as service offers, from Nearshoring; (4) the suppliers or service providers of Nearshoring Partners; and furthermore, all persons who contact Nearshoring Partners or whose personal data Nearshoring Partners processes.

Data processing and storage.Personal data is defined as all identified or identifiable data from an individual, including without limitation: the name, phone number, email address, personal website, contact information provided at a seminar, IP address (if the customer/prospect) visits Nearshoring Partners’s website) or data that, which Nearshoring Partners has found on social media, such as Linkedin. Nearshoring does not store the personal data for longer than necessary for the purposes mentioned below under 3). The criterion is storage in order to comply with: (1) a statutory obligation and (2) to maintain contact at the request of the customer, for example in connection with the completion or transition of a services or other agreement.

Data processing and use.(1) Nearshoring Partners processes personal data to the extent necessary to carry out the agreement with the customer and to be able to provide a host of IT services, as described on Nearshoring’s website;(2) Nearshoring processes personal data for billing of legal services rendered by it, or to pay its suppliers or service providers; (3) Nearshoring uses personal data from its customers and contractors to establish and maintain contact; (4) In some cases, Nearshoring Partners will process identity data because of a statutory obligation. Nearshoring will process these identity data and make a copy of the identification document.

Legal basis for processing.Nearshoring processes the personal data referred to in paragraph 3 on the basis of : (1) permission from its customer/prospect (who can at all times revoke the permission granted);(2) an agreement or in the phase prior to an agreement ; (3) a statutory obligation; and (4) a legitimate interest, such as defined in the General Data Protection Regulation (GDPR).

Processors.Nearshoring Partners engages service providers in the processing of certain personal data. These service providers process personal data only on behalf of Nearshoring. Nearshoring entered into data processor agreements, which meets the requirements of the GDPR, with these service providers.

Sharing of personal data with third parties.Nearshoring Partners share personal data with third parties under the following circumstances: (1) when a court ruling requires Nearshoring to disclose the personal data to third parties, or (2) when Nearshoring organises a joint activity such as an event or seminar with a third party.

Questions or complaints?Questions or complaints regarding the processing of personal data by Nearshoring can be posed or reported to the contact person mentioned below.Nearshoring’s business relations have the right to inspect, and request rectification and deletion of their personal data. They may also object to the use of personal data by Nearshoring or ask to restrict the use. If a complaint does not result in a satisfactory solution, then Nearshoring mentions that the business relations can always turn to the Dutch Authority on Personal Data.
